However, if your situation is not violent, but is destroying you financially due to gambling, depression, drug use, you need to act. By allowing the behavior to continue, you are consenting to the action. Many times, we have clients come to us who have suffered for years, seeking to make it right, seeking to punish the other party for the years of abuse.
Unfortunately, the court is woefully inadequate and rarely will right the past wrongs.
We can get some relief for dissipation of assets that were taken without your knowledge or consent, and used for someone else (need proof), but years of drinking or gambling cannot be undone if you allow it to continue.
Payments for rehabs, DUI attorneys, etc. are marital….you cannot come to the court and say your spouse lost money gambling so you want it back. Did you keep the winnings? These cases are very emotional and difficult, particularly when it occurs over many years.
